Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the gifukai.com website and the Gifukai API (together, the “Service”), operated by Gifukai (“we”, “us”, “our”).

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, you must not use the Service.

1. Eligibility

You must be at least 13 years old to use the Service.

2. Scope of Service

The Service provides a website and a free REST API that index and redistribute short anime reaction clips and GIFs for entertainment and developer use, such as powering Discord bot interaction commands (/hug, /kiss, /pat, and similar).

The Service is provided free of charge. No account or API key is required to use the public API.

3. Content Ownership

Section titled “3. Content Ownership”
  • We do not own the anime, images, or GIFs made available through the Service.
  • The media consists of short clips taken from third-party anime works and is redistributed for identification and entertainment purposes, with the source anime named in API responses where possible.
  • All rights remain with the respective content owners.

You are responsible for ensuring that your use of the content complies with applicable laws and the rights of the original creators.

4. Acceptable Use

You may use the Service in your own apps and bots, including in monetized or commercial Discord servers, provided you follow these Terms.

You agree not to:

  • scrape, bulk-download, or perform automated extraction or archiving of the GIF library;
  • rehost or redistribute the GIF library as a competing dataset or service;
  • use the content, or any tool built on the Service, to train, fine-tune, or build datasets for AI or machine-learning models;
  • remove or obscure source attribution provided in API responses;
  • circumvent rate limits, abuse detection, or other safeguards; or
  • abuse, overload, or intentionally disrupt the Service.

Permission to use content for AI/ML training cannot be granted, as we do not own the underlying content.

5. API Usage

The public API has no API keys and currently imposes no published rate limits. We may nonetheless apply rate limiting, traffic filtering, and abuse detection at any time to keep the Service available for everyone.

6. Enforcement

Violations of these Terms may result in rate limiting or temporary or permanent IP-based bans from the Service. No user accounts are required to use the public API, so enforcement is primarily IP-based.

7. Disclaimer

The Service is provided “as is” and “as available”, without warranties of any kind. We do not guarantee availability, accuracy, reliability, or error-free operation.

8. Limitation of Liability

To the maximum extent permitted by applicable law, we shall not be liable for any indirect, incidental, consequential, or special damages arising from the use of, or inability to use, the Service.

9. Governing Law

These Terms are governed by the laws of Spain, excluding its conflict-of-law rules.

10. Severability and Waiver

If any provision of these Terms is found unenforceable, the remaining provisions will remain in effect. Our failure to enforce any provision is not a waiver of that provision.

11. Changes to These Terms

We may update these Terms from time to time. The “Last updated” date above reflects the latest revision. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
